Terms and Conditions
Please read this carefully because it sets out the terms of a legally binding agreement between you and Rouleur (Gruppo Media Limited). Index to sections
1. Introduction
The following Rouleur Subscription General Terms and Conditions (the “General Terms”) together with the specific terms and conditions of your Magazine subscription offer as set out on the applicable website sign-up pages, hard copy subscription offer page (such as a leaflet, brochure or advertising collateral) or otherwise advised to you during the sign up process (the “Specific Terms”) form a legally binding agreement between you and Rouleur (“Agreement”). The Specific Terms take precedence over these General Terms if there is any inconsistency between the two.
This Agreement sets out the terms on which you may subscribe to receive Rouleur magazine (”Subscription”).
By agreeing to purchase a Subscription you are agreeing to the terms and conditions of this Agreement. If you do not agree with the terms and conditions of this Agreement you should not take out a Subscription.
References in these terms and conditions to “Rouleur” (or “we”, “us” or “our”) refer to Gruppo Media Limited, trading as Rouleur entity with which you are contracting under this Agreement.
2. Subscriptions
Placing your order: By submitting your payment and other Subscription details, you are making an offer to us to buy a Subscription. A contract is formed when we have accepted your offer, at which point we will provide the Subscription to you. General: If you purchase a Subscription the Magazine will be delivered to an address of your choice. We cannot guarantee delivery to shared or communal mailboxes, or where buildings have do not concierge facilities available. Once your application to subscribe has been accepted, Rouleur will aim to commence delivery of the Magazine to you with the next available issue. Any failure to commence delivery within the foregoing timescales will not constitute a breach of this Agreement. Once delivery has commenced, the Magazine will be delivered at the frequency and at the delivery address(es) specified when your order was confirmed. If you reside outside of the UK, we will deliver your Magazine to your specified address by post, and such delivery will be subject to normal postal delays. If you have not received your Magazine, please contact us. If we are notified by you of your non-receipt of your Magazine within 30 days of the failed delivery date, we will send a replacement copy, unless you are informed otherwise by Rouleur.
We may use third parties to assist us in the provision of the Subscription services to you.
Your Subscription period will be either annual, unless another Subscription period is made available to you (which will be stated in the Specific Terms or on our sign-up pages or otherwise made clear during the sign-up process). For example, we may offer quarterly, half yearly or 24 month Subscriptions.
Trials or Discount Offers: We may from time to time and at our discretion make Subscription trials available to new subscribers (which may be free trials or discounted trials (for example, pay £1 for the first month’s Subscription)) in which case we will only charge you for your full Subscription fees with effect from the expiry of the trial period. No more than one trial per subscriber or at a single household is allowed in any twelve month period.
Pricing and Payment: The Subscription fees will be made clear to you on our sign-up pages or otherwise during the sign-up process. The Subscription fees may vary from time to time and by country or by state, district or region. You agree to pay the fees at the rates and frequencies notified to you at the time you take out your Subscription. Rouleur will charge you in British Pounds Sterling, United States Dollars, Euros, or such other currency stated during the sign-up process depending on the service and your country of residence. You may also have to pay any applicable local taxes. Eligibility for any discounts is ascertained at the time you subscribe and cannot be changed during the term of your Subscription. We will always tell you in advance of any increase in the price of your Subscription.
When you subscribe you must provide us with complete and accurate payment information. Where applicable, you may pay online by credit card, Paypal, direct debit or in some cases offline by credit card, cheque or bank transfer, or by other methods that we may make available. By submitting payment details you promise that you are entitled to purchase a Subscription using those payment details. If we do not receive payment authorization or any authorization is subsequently cancelled, we may immediately terminate or suspend your Subscription and may in suspicious circumstances contact the issuing bank/payment provider and/or law enforcement authorities/other appropriate third parties. If you are entitled to a refund under this Agreement we will credit that refund to the card, bank account or other payment method you used to submit payment, unless it has expired in which case we will contact you. In no event shall Rouleur be responsible for lost orders or payments. In the case of unauthorised payments Rouleur reserves the right to suspend or terminate your Subscription. Rouleur reserves the right to cooperate with the relevant authorities in the event that Rouleur, at its sole discretion, suspects that any payment is fraudulent or otherwise unlawful.
Pricing errors: If we incorrectly state a price to you whether online or otherwise, we are not obliged to provide you with a Subscription at that price, even if we have mistakenly accepted your offer to buy a Subscription at that price, and reserve the right to subsequently notify you of any pricing error. If we do this, you may cancel the Subscription without any obligation to us and we will refund you any money you have paid us in full or you may pay the correct price. If you refuse to exercise either of these choices then we may cancel your Subscription and will refund you any money you have paid us in full. We will always act in good faith in determining whether a genuine pricing error has occurred.
Other costs: In addition to the subscription fees you are charged, certain banks and credit card issuers will charge a foreign transaction fee on transactions which take place abroad or in a foreign currency. The majority of payments for subscriptions we take by card are processed in the United Kingdom therefore please check with your bank or credit card issuer to find out if such charges will be applied to you; the Rouleur is not responsible for any such charges.
3. Cancellation or suspension of your subscription
Initial cancellation period: You have the right to cancel your Subscription, without giving any reason, at any point within the Subscription period. If you exercise your right to cancel within the period, then we will reimburse all payments received from you, less a pro-rated amount for each magazine you received before cancelling. You do not need to return any of the magazines to us.
How to cancel or suspend your subscription: Email us at info@rouleur.cc or call us on 02071993817 to communicate your cancellation, including the following information:
• The full name of the subscriber
• The Account email address
• The billing address or delivery address
Cancellations and suspensions will only be effective once Rouleur receives notice of them.
Renewals: If you have chosen to pay through a continuous billing method such as credit card/Paypal recurring transactions or direct debit, then unless you notify us before the end of your Subscription period that you no longer wish to receive your Subscription, your Subscription will renew for another period. We will charge for the Subscription using the same card or other payment method that you previously used. We will notify you in advance of any changes to the price in your Subscription that will apply upon renewal.
For all other Subscriptions, we will send you an email or notice letting you know when your annual Subscription is close to ending (unless you have already told us that you wish to cancel your Subscription). We will also ask you whether you would like to renew your Subscription. If you fail to respond to these notices or you fail to pay your renewal invoice, your Subscription will expire on its end date.
Moving house: If you are moving house, then we may be able to transfer your magazine or voucher delivery to your new address, provided that you advise us of your change of address. However if you are moving country, depending on which country you are moving to, we may have to cancel your Subscription, provide you with a pro rata refund for your Subscription and set up a new Subscription at the new address, to be paid for separately. If we are unable to provide you with magazine delivery to your new address, we may contact you to offer alternative products or services or provide you with a pro rata refund for your Subscription.
Cancellations by us: Rouleur reserves the right to suspend or terminate your Subscription if you breach this Agreement, with or without notice and without further obligation to you. You will not be entitled to any refund in these circumstances. If however we terminate or suspend your Subscription for any other reason and/or permanently cease publishing the Magazine or cease to provide Subscription services then, unless there are exceptional circumstances, we will provide you with a pro rata refund to your credit card or bank account, which means that we will refund you with any amounts that you have paid us in advance that relate to any remaining and unexpired period of your Subscription and that shall be our only responsibility to you in respect of such termination. This includes if we suspend or terminate your subscription because we are prevented from providing services to you by circumstances beyond our control.
4. Privacy Policy and Registration
All information provided by you in order to purchase a Subscription will be used by Rouleur in accordance with our Privacy Policy. Please read this for details of how we may process your personal data.
You must provide ROULEUR with accurate, complete registration information (including but not limited to name, delivery and billing address and direct debit/bank account or credit card details) and email address. It is your responsibility to update and advise us of all changes to that information. Rouleur is entitled to rely on all information you provide to us.
5. Who Your Contract is with
You are contracting with Gruppo Media Limited, whose registered address is Somerset House, Strand, London, WC2R 1LA.
6. Choice of Law and Jurisdiction
This Agreement will be subject to English law. In this case, to the extent possible in the applicable jurisdiction, both you and we agree that the courts of England will (subject to the final paragraph in this Section 5) have non-exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with this Agreement.

8. Content ownership
All content published in the Magazine belongs to Rouleur or its licensors who own all intellectual property rights (including copyright and database rights) in that content and any selection or arrangement of it. No intellectual property rights in that content are transferred to you. “Rouleur” is a registered trade mark and it may not be used without written permission from Rouleur. You may not copy, publish, republish, archive, store, create derivative works of, redistribute or disseminate to third parties any content from the Magazine. Any third party advertising or sponsorship in the Magazine is the responsibility of the relevant third party and ROULEUR is not responsible for it.
You may not license or transfer any of your rights under this Agreement.
9. Changes to this Agreement
These terms and conditions were published on 20 June 2018 and replace with immediate effect the terms previously published on 20 September 2017.
Rouleur Retail
1. IN GENERAL
Access to and use of this Web site and the products and search services available through this Web site (collectively, the "Services") are subject to the following terms, conditions and notices (the "Terms of Service"). By using the Services, you are agreeing to all of these terms, conditions and notices, without modification. Furthermore, you acknowledge that the Terms of Service may be updated by us from time to time. This Web site also contains links to other Web sites, Web pages and services, which are not operated by Rouleur (Gruppo Media Limited) (the "Linked Sites"). Your use of such Linked Sites will be subject to the terms of service contained within each such site and the respective terms of service will control the use of the respective site. In any event your link through to such a site will be subject to the these Terms of Service. You recognise that Rouleur (Gruppo Media Limited) has no control over such Linked Sites and information, and you accept that Rouleur (Gruppo Media Limited) provides no guarantee as to the accuracy or reliability of such sites or the information contained in them and you agree that we shall have no responsibility as to whether such links locate unintended or objectionable content or otherwise cause you distress, loss or damage.
2. PROHIBITIONS
You will not: commit or encourage a criminal offence; send or receive any material which is in any way offensive or obscene, or in breach of confidence, copyright, privacy or any other rights; act contrary to the acceptable use policies of any Linked Sites or community standards generally; transmit or distribute a virus; hack into any aspect of the Service; corrupt data; cause annoyance to other Users; infringe upon the rights of any other person's trade marks or other proprietary rights; send any unsolicited advertising or other promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through the Rouleur Web site.
3. INTELLECTUAL PROPERTY
Software & Content
The intellectual property rights in all software made available and content supplied to you remains the property of Rouleur (Gruppo Media Limited), its licensors, advertisers or content suppliers. You will comply with the terms of any agreement required by the owner of intellectual property rights in all software and content supplied to you as notified to you and you hereby acknowledge that all software that is not made readily available to you is confidential, and that all other rights including but not limited to database rights and copyright are asserted and reserved by Rouleur (Gruppo Media Limited), its licensors, advertisers or content suppliers. You may store, manipulate, analyse, reformat, print and display the content supplied solely for your own personal use. In no event are you permitted to publish, distribute or otherwise reproduce in any format any of the content or copies of the content supplied to you or which appears on the Rouleur site and you are prohibited from using any such content in connection with any business or commercial enterprise including, without limitation, any media business or enterprise. You shall not modify, translate, reverse engineer, decompile, disassemble (except to the extent that applicable laws expressly or impliedly prohibit such restriction) or create derivative works based on any software or any documentation accompanying such software supplied by Rouleur (Gruppo Media Limited), its licensors, advertisers or content suppliers. No license or consent is granted to you to use these marks in any way, and Rouleur (Gruppo Media Limited) reserves all rights in these and any related marks. You agree not to use these marks or any marks which are colourably similar
4. E-TAIL OF PRODUCTS AND SERVICES
By making a request/order you are offering to purchase a product which we will accept to sell to you on the following Terms and Conditions. All requests are subject to availability and confirmation of the order price by us. We deem our acceptance of an offer to buy from us upon dispatch of the goods to you. We reserve the right to cancel any offer made by the customer to buy products from Rouleur up and until we finally dispatch the goods bought and we communicate the items dispatch to the customer via email of other means of communication. Dispatch times may vary according to availability and any guarantees warranties or representations made as to delivery times are limited to mainland UK and are on the basis that we are not responsible for any delay in delivery occurring due to postal delays or force majeure. Rouleur (Gruppo Media Limited) are absolutely entitled to refuse any request made by you. If your order is accepted we will inform you by emailing you or else by calling you. We will also provide the identity of the party you have contracted with. This may be Rouleur (Gruppo Media Limited) or in certain cases a third party. Where a contract is made with a third party Rouleur (Gruppo Media Limited) is not acting as either agent or principal and the contract is made between yourself and that third party. When making a request you undertake that all details you provide to us requesting goods or services or bids made at auction are true and accurate, that you are an authorised user of the credit or debit card used to make your request or bid and that there are sufficient funds to cover the cost of the goods, services or bid. It is your responsibility to inform us of any changes to these details as soon as possible. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.
5. DISCLAIMER OF WARRANTIES
The services and all information, products and other content included in or accessible from this web site and the linked sites, are provided on an "as is" and "as available" basis and are subject to change at any time without notice to you. To the fullest extent permitted by law, Rouleur (Gruppo Media Limited) disclaims and excludes all representations and warranties (express, implied and statutory, including but without limitation the warranties of merchantability and fitness for a particular purpose, and non-infringement of proprietary rights) as to the services and all information, products and content included in and accessible from this web site or the linked sites.
6. DISCLAIMER of LIABILITY
Unless expressly stated to the contrary to the fullest extent permitted by law Rouleur (Gruppo Media Limited), its content providers, advertisers or linked sites shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this web site or the linked sites, even if Rouleur (Gruppo Media Limited) had been advised of the possibility of such damages and irrespective of whether such damages arise in contract, tort, equity, restitution, by statute, at common law or otherwise. You have read this disclaimer and agree to it on the basis that you agree it is reasonable.
7. DISCLAIMER AS TO OWNERSHIP OF TRADE MARKS
Images of personalities and third party copyright
Except where expressly stated to the contrary all persons including their names and images, third party trade marks and images of third party products, services and locations featuring on the Rouleur (Gruppo Media Limited) web site are in no way connected, associated, linked or affiliated to Rouleur (Gruppo Media Limited). Furthermore, unless it is expressly stated on the Rouleur web site that a certain product, service or location is connected, associated, linked or affiliated to the makers, right owners or broadcasters (the "makers") of a film or programme you should not make such an assumption, or rely in any way on the existence of such a connection, association or affiliation, by implication or otherwise. Any trade marks/names as may be featured on the Rouleur web site are owned by the respective trade mark owners and Rouleur (Gruppo Media Limited) claims no connection, association or affiliation with them. Where a trade mark (brand name) is referred to it is used to describe or identify the products, services or locations (the "goods") or else it is used to identify the film or programme where such goods appeared, but that is in no way an assertion or claim that such goods are endorsed by or connected, associated, linked or affiliated to the makers of the relevant film or programme.
8. INDEMNITY
You agree to indemnify, defend and hold harmless Rouleur (Gruppo Media Limited), its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from, without limitation, your use of the Rouleur (Gruppo Media Limited) services, your breach of the Terms of Service, your infringement of any intellectual property right or any other right of any person or entity, or your breach of any duty of confidence or privacy, or any defamatory statements made by you in any form.
9. VARIATION OF CONTENT
Rouleur (Gruppo Media Limited) shall have the right in its absolute discretion at any time and without notice to amend, remove or vary any of the content supplied in connection with the Service or which appears on any page of the Rouleur Web site. This includes the description of products and their sizing. Rouleur (Gruppo Media Limited) will always do their best to be accurate. All sizes are approximate. Material can change season to season, and Urban Industry are not responsible if a Brand changes the material used.
10. SUBMISSIONS
All information and material submitted by you to Rouleur (Gruppo Media Limited) or that you publish on any public area of the Rouleur Web site shall be provided by the submitter and accepted by Rouleur (Gruppo Media Limited) on a non-confidential basis subject to paragraph 2 above. Furthermore, Rouleur (Gruppo Media Limited) shall be granted a perpetual royalty-free non-exclusive license in the copyright of any material submitted and Rouleur (Gruppo Media Limited) shall be free to use, edit, copy, republish and distribute (for any purpose) and authorise others to do the same, any such information or material and any ideas contained in such information or material.
11. TERMINATION
Rouleur (Gruppo Media Limited) may at any time terminate or suspend any part of the Service without notice to you.
12. INVALIDITY
If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.
13. GOVERNING LAW AND JURISDICTION
Upon entering the Rouleur site you are bound by these terms and conditions. These terms and conditions are to be construed in accordance with the laws of England and Wales and irrespective of your place of domicile, in the event of any dispute associated with these terms and conditions, that dispute shall be subject to the exclusive jurisdiction of the English High Court, the Strand, London. Any dispute in any way referable to the content of this site whether in respect of its trade marks, copyright or image content shall be resolved exclusively by arbitration the terms of which are to be agreed between Rouleur (Gruppo Media Limited) and yourself and provide no right or recourse to any relief of the English Courts whether interim or otherwise and that by accessing this site you waive your right for all time to any such right.
14. ENTIRE AGREEMENT
The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Rouleur (Gruppo Media Limited). Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of Rouleur (Gruppo Media Limited).
15. ROULEUR PARTNER PROMOTION TERMS AND CONDITIONS
Rouleur Subscribers offer
If you have an active subscription to Rouleur magazine through our approved providers, you are entitled to a 10% discount off the original sale price of all shop products. Discounts will not be applied to items already reduced as part of a sale. Rouleur (Gruppo Media Limited) reserve the right to exclude certain products from the discount. You must enter a valid subscriber number during the checkout. All discounts will cease, as soon as your magazine subscription ends.
It is forbidden for anyone other than the magazine subscriber to use the subscription number for discounts. Anyone found to be sharing their discount will have their subscriber discount suspended with immediate effect.
Promo Discount codes
Promotional discount codes are published for time to time. One code maybe used at a time, not in conjunction with any other offers unless advertised in the promotional description. There is no cash or other alternative product available.
Order Cancellations
Under the United Kingdom's Distance Selling Regulations you have the right to cancel your order for any item purchased from Rouleur (Gruppo Media Limited), for a full refund. Order Cancellations must be made in writing, quoting your order number, within 7 working days of the day after you receive the goods to Customer Care. If however your order has already been processed, you will need to return the order to us. Please note that you as the customer is responsible for the cost of returning the item to us after order cancellation.
16. ORDER INCORRECT
Return an item
If you are not completely satisfied with your purchase, simply return the item or items to us in their original condition* within 30 days of receipt. We will issue a refund on receipt. However delivery charges are only refundable if you have cancelled your entire order within the 7 day Cooling-Off Period or where the goods are faulty and a refund is made. Please see the paragraph above detailing that you must bear the charge of returning any items to us. Items missing from your parcel The customer must inform us if there are any items missing from your parcel within 24 hours of the parcel being delivered. Failing to do so will mean that Rouleur (Gruppo Media Limited) will not be able to compensate the customer in any way.
17. PRE-BUY / PRE-ORDER ITEMS
Occasionally we will offer products for pre-order due to limited edition deliveries or long lead times. These terms cover our pre-order service. a. Full payment for the item is taken at the time of order. b. All delivery dates are estimated, occasionally delivery to the customer may be extended beyond our control. We will try to notify customers of this via email, Facebook or twitter where necessary. c. Pre-orders are taken by us in good faith in that we have ordered the item in question from the brand and that they will be delivered to us around the estimated delivery time. Occasionally our full delivery of items may be reduced, be late, not arrive at, all of which are out of our control. d. In circumstances where we cannot fulfil a Pre-ordered item Rouleur (Gruppo Media Limited) will refund any monies including shipping costs as soon as possible and notify the customer according. We will endeavour to do this as soon as possible. e. You may cancel your pre-order with us for a full refund at any time up until we dispatch the item to you. Please make any cancellation requests in writing via email to our customer service team. f. The images of pre-order items are usually taken of samples supplied at the time of ordering, these are open to change upon production by the brand. Our images should be taken as an approximation of the final delivered product.
